Risk, responsibility and limits of liability

Your legal rights come first. Nothing in these Terms, the Disclaimer, any download notice or any other agreement with us excludes or restricts liability for death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any other liability or consumer right that cannot lawfully be excluded or restricted. This includes applicable rights concerning reasonable care and skill, faulty or misdescribed digital content, and damage to your device or other digital content where the law makes us responsible. These protections apply equally to every person referred to below.

Technical risks. Downloading, installing or updating software, running 3D games and using online services involve risks, including software faults, incompatibility, service interruption, loss of unsaved progress, increased battery use, device heat and data usage. To the extent that these risks are not our legal responsibility, you choose whether to use the Services and accept those ordinary risks. This is not an agreement that you accept the risk of our negligence merely because you have read or accepted a notice.

Check compatibility before installing, keep your operating system and security software updated, back up important data, obtain downloads only through our official website or linked release pages, and stop playing if your device overheats or you feel unwell. Keep audio at a safe level and take breaks from screens. These precautions do not remove our legal duties or make you responsible for loss caused by our failure to meet them.

Availability and development. Faithful Radio World is an ongoing project. We do not promise that the Services will be uninterrupted, free from every defect, compatible with every device, or available offline. The mobile home-screen version requires internet. Subject to applicable law and any specific promises made to you, we may maintain, update or change free features. This does not remove remedies for paid content or entitle us to disregard a contract or statutory rights.

Losses. We are responsible for loss or damage that is a reasonably foreseeable result of our breach of contract or failure to use reasonable care and skill, subject to applicable law. We do not exclude such responsibility merely because the service is free or the loss is described as indirect. To the extent the law permits, we are not responsible for loss that was not reasonably foreseeable, loss not caused by our breach or other legal fault, or loss caused solely by your misuse contrary to clear instructions. The Services are supplied for personal, non-commercial use; to the extent lawful, we exclude business losses such as loss of profit, business, revenue or business opportunity arising from that use.

These lawful limitations apply to David Arnold, trading as Faithful Radio, and, only in connection with their work for the Services, our owners, employees, volunteers, representatives and associates. They do not give anyone immunity for their own unlawful conduct, remove an independent duty of care, or stop you making a complaint, reporting a concern, bringing a lawful claim or seeking a remedy.

Other people and services. We do not endorse every member post or control every external website, device, network or third-party service. A link is not a guarantee of its safety or accuracy. Our responsibility for our own choices, moderation, safeguarding, data protection and other legal duties remains; we do not disclaim that responsibility by referring to a third party.
